USER AGREEMENT
Dome is a digital booking platform by Daflo Innovations that lets users book sports courts and
other facilities, process payments via Stripe, and manage reservations across mobile and web
interface. The terms below are a user-facing “Terms and Conditions” for Dome.
1. Our Service
Daflo Innovations Inc. (“Daflo”) provides the Dome digital booking applications that allow users
to book courts and other facilities from participating sports facilities (“Venue”). Dome includes
the Dome Mobile Application, Dome User Web Booking Application, and Dome Vendor Web
Booking Application, which together enable online and in‑person bookings and payments
processed by Stripe.
By creating an account or making a booking through Dome, you (“you”, “your”,“User”) enter
into a direct contractual relationship with the Venue in respect of each booking; Daflo is not a
party to the service contract between you and the Venue. The Venue is solely responsible for all
information it provides in Dome, including prices, availability, facility descriptions, and any
Venue‑specific rules or policies.
Daflo acts as an intermediary that:
Provides the Dome software to facilitate booking and payment between you and the Venue.
Integrates with the Stripe payment gateway to support card payments and payouts.
2. User Accounts and Use of Dome
To make bookings or manage reservations, you may be required to create a Dome user account
and provide accurate personal details (such as name, email address, and payment details where
applicable). You must:
Provide truthful, current, and complete information and keep it updated.
Maintain the confidentiality of your login credentials and not share your account with others.
You are responsible for all activity that occurs under your Dome account, including bookings
made and payments authorized. If you suspect unauthorized use of your account, you must
notify Daflo and, where applicable, the Venue promptly.
You agree not to:
Use Dome for fraudulent, misleading, or unlawful purposes.
Interfere with the proper operation, security, or performance of Dome.
Attempt to reverse engineer, modify, or exploit Dome outside the scope permitted under
applicable agreements.
3. Payment of Bookings
3.1 Payment Channels
Dome supports multiple booking and payment flows across its applications:
Dome Mobile Application: Enables users to pay for bookings by credit or debit card using Stripe
as the integrated payment processor.
Dome User Web Booking Application: Enables users to pay for bookings by credit or debit card
using Stripe as the integrated payment processor.
Dome Vendor Web Application: Enables venue staff to create bookings on behalf of users,
including options to (a) reserve a slot and arrange payment directly with the venue at a later
time, or (b) use point of sale payment method the venue offers
3.2 Card Payments via Stripe
When you make a booking through the Dome Mobile Application or Dome Web Booking
Application, you may be required to provide valid card details at the time of booking. Your card
is charged or authorized via Stripe in accordance with the payment flow presented to you. Card
details are collected and processed by Stripe in a secure manner consistent with industry
standards and are not stored on Dome’s application servers.
By submitting your card details through Dome, you authorize Stripe to process payments on
behalf of the venue and authorize the venue to charge your card for booking amounts,
applicable taxes, and any other charges disclosed in the booking flow or the venue’s policies.
3.3 “Call and Reserve / Pay at Venue” Bookings
When a booking is created through the Dome Vendor Web Application by calling the venue
directly, no card payment is processed through Dome at the time of booking. In such cases:
The booking is recorded in Dome as reserved.
You agree to settle payment directly with the venue using the methods and timing
communicated by the venue (for example, payment on arrival at the facility).
The venue is solely responsible for collecting payment and applying any cancellation, no‑show,
or late‑payment policies.
3.4 Fees, Chargebacks, and Responsibility
All online card payments processed through Dome Mobile Application, Dome User Web
Booking Application and Dome Vendor Web Booking Application are subject to Stripe’s
standard processing terms and fees, which are applied to each transaction before payouts are
split between the Venue and Daflo as described in the Client Service Agreement. Stripe
disburses funds directly to the Venue and to Daflo according to the configured split.
Any disputes or chargebacks initiated with your card issuer will be handled under your issuer’s
and Stripe’s rules, and may result in adjustments, penalties, or other actions applied to the
venue’s account.
Dome does not operate an escrow or custodial service and does not hold user funds.
Responsibility for the underlying facility services, refunds, and any adjustments to booking
charges rests with the venue, in line with its policies and applicable law.
3.5 Card Data Handling and Authorization
When you provide card details in Dome, the card data is transmitted directly from your device
to Stripe or the Venue’s payment gateway via secure, industry‑standard SSL connections.
Sensitive card data (such as full card numbers and verification codes) is not stored on Dome’s
application servers. Refer to this page for details on stripe security mechanism.
By submitting your card information through Dome, you:
Authorize Stripe to verify your card and charge your card for booking amounts, applicable
taxes, and any fees disclosed in the booking details.
Authorize the Venue to charge your card for booking amounts, applicable taxes, and any fees
disclosed in the booking details.
3.6 Fees and Chargebacks
Card transactions are subject to Stripe’s processing fees, which are deducted from each
booking payment before payouts are split between the Venue and Daflo as described in the
Client Service Agreement. Daflo does not operate an escrow or custodial service and does not
hold user funds; Stripe disburses funds directly to the Venue and to Daflo according to the
configured split.
If you believe a charge is unauthorized or incorrect, you may have the right to initiate a
chargeback through your card issuer, subject to your issuer’s terms and applicable law. Venues
may incur fines or penalties if charge disputes are resolved in your favor, and repeated disputes
may result in the Venue’s payment account being restricted by the payment provider.
Daflo is not responsible for:
Any decision by Stripe or a bank related to authorizations, settlements, chargebacks, or payout
delays.
Any additional fees, penalties, or account actions imposed on the Venue by payment providers.
4. Bookings and Cancellations
4.1 Booking Contract
Each booking you make through Dome forms a direct contract between you and the Venue for
the use of the booked facility at the scheduled time. Dome is a technology platform only and is
not responsible for the Venue’s performance, cancellations, or service quality.
4.2 User‑Initiated Cancellation
Users can cancel eligible bookings directly through the Dome Mobile Application and Dome
Web Booking Application using the Cancel Booking option. This self‑service cancellation is
available up to twenty‑four (24) hours before the scheduled booking start time. By making a
booking, you acknowledge and agree that cancellations after this 24‑hour cutoff cannot be
completed through self‑service and must be addressed directly with the venue, which may
refuse late cancellations or refunds.
4.2 Automatic Refund Processing
When you cancel a booking within the permitted self‑service cancellation window, Dome will
automatically trigger a refund transaction via Stripe on behalf of the venue. The refund will be
processed to the original payment method, subject to Stripe’s processing times and your card
issuer’s policies. The venue remains responsible for configuring its refund preferences and
complying with applicable laws, but the refund initiation itself occurs automatically once you
successfully complete the self‑service cancellation.
4.3 Stripe Fees and User‑Borne Penalties
Cancellations processed through the self‑service flow may incur penalties that allocate Stripe’s
payment processing fees to you instead of the venue. In practice, this means:
The venue may refund only the booking amount net of the original or applicable Stripe
processing fees, so you receive a reduced refund amount.
Alternatively, the venue may refund the full booking amount but separately charge or retain an
amount equivalent to Stripe’s processing fees as a cancellation penalty.
The exact treatment of processing fees on cancellation (including any non‑refundable
components retained by Stripe) will be reflected in the refund amount you receive and may
differ by venue, card type, and jurisdiction. By using the self‑service cancellation option, you
agree that Stripe’s processing fees associated with your booking may effectively be borne by
you upon cancellation.
4.4 Venue‑Initiated Changes or Cancellations
Because your contract is with the Venue, the Venue may, at its discretion, cancel, reschedule,
or modify your booking (for example, due to facility issues, overbooking, or safety concerns).
The Venue is solely responsible for any remedies it offers (such as refunds, credits, or
alternative time slots), and you must resolve such matters directly with the Venue.
5. Use of Booking Information
The Venue agrees to use your contact information with discretion, not to engage in spamming,
and not to pass your details to third parties without your express consent, except as required
by law.
6. Communications
By completing a booking or registering an account on Dome, you agree to receive electronic
communications related to your use of Dome and your bookings, including:
Booking confirmations, updates, and cancellation notices.
Notifications if the Venue modifies your booking or charges your card using Dome’s
interfaces.
Security and account‑related communications (e.g., password reset emails, profile
changes).
Daflo does not send unsolicited marketing emails unless you have specifically opted in
according to applicable law. Venues may send you additional communications in accordance
with their own policies and your consents.
7. Privacy and Data Protection
Daflo uses high ethical standards and implements technical and organizational measures to
protect the privacy and confidentiality of your personal data, including your contact
information and booking history. Card details that you enter via Dome are processed and
stored by Stripe or the relevant payment provider, not by Dome’s application servers.
Daflo and the Venue agree to use personally identifiable information about Users only as
necessary to:
Provide, manage, and support bookings and payments.
Communicate about bookings, account security, and platform usage.
Comply with legal and regulatory obligations.
Daflo will not sell or otherwise commercially exploit your personal data to third parties, and the
Client Service Agreement similarly restricts the Venue from selling or sharing user data except
as required to deliver services and comply with law. For more detail about how Dome collects
and uses data, please refer to the Dome Privacy Policy (as may be made available within the
applications or website).
8. Intellectual Property
All intellectual property rights in the Dome platform—including the mobile app, web booking
portal, software code, user interface, design, and related documentation—are owned by Daflo
Innovations Inc. or its licensors. You receive a limited, non‑exclusive, non‑transferable,
revocable right to access and use Dome solely for making and managing legitimate bookings in
accordance with these Terms.
You may not:
Copy, modify, adapt, translate, reverse engineer, decompile, or create derivative works
from Dome, except where such restrictions are prohibited by law.
Remove or alter any proprietary notices or trademarks displayed in Dome.
Nothing in these Terms grants you any ownership rights in Dome or related intellectual
property.
9. Platform Availability and Service Limitations
Daflo aims to maintain high availability of Dome, and under its Client Service Agreement
commits to a target uptime (excluding scheduled maintenance and force majeure events).
However, Dome may be temporarily unavailable due to maintenance, updates, or events
beyond Daflo’s reasonable control.
Daflo does not warrant that Dome will be uninterrupted, error‑free, or free from security
vulnerabilities, but will use commercially reasonable efforts to address critical incidents and
maintain service performance. You are responsible for maintaining the hardware, software, and
internet connection necessary to access Dome.
10. Disclaimers
To the maximum extent permitted by applicable law:
Dome and all related services are provided on an “as‑is” and “as‑available” basis, without any
warranties of fitness for a particular purpose, non‑infringement, or uninterrupted availability,
except as expressly set out in any applicable agreement.
Daflo does not warrant or guarantee the quality, safety, legality, or suitability of any Venue,
facility, equipment, or services you access as a result of using Dome.
Your decision to book and use any Venue’s facilities is at your own risk, and you should
independently assess the Venue’s suitability, including reviewing its policies and safety
standards.
11. User Responsibilities and Indemnity
You are responsible for:
Complying with all Venue rules, regulations, and safety instructions when using booked
facilities.
Using Dome only for lawful purposes and respecting any applicable codes of conduct or facility
rules.
To the extent permitted by law, you agree to indemnify and hold harmless Daflo and its
affiliates, officers, and employees from and against any third‑party claims, damages, injury,
liability or expenses wholly or partly arising out of:
Your misuse of Dome.
Your breach of these Terms.
Your violation of any law or third‑party right in connection with your use of the platform.
12. Governing Law and Dispute Resolution
Unless otherwise required by local consumer protection law, these Terms and your use of
Dome are governed by and construed in accordance with the laws of the Province of Ontario,
Canada, without regard to its conflict‑of‑law rules.
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of Dome
should first be addressed informally between you and Daflo. If not resolved, disputes may be
brought before the competent courts of Ontario, subject to any mandatory consumer
protection provisions that grant you additional rights in your jurisdiction.
13. Changes to These Terms
Daflo may update these Terms from time to time to reflect changes in Dome, legal
requirements, or business practices. When changes are material, Daflo will provide reasonable
notice (e.g., via the app, website, or email) and indicate the effective date.
Your continued use of Dome after the updated Terms become effective constitutes your
acceptance of the revised Terms. If you do not agree to the changes, you must stop using Dome
and, if applicable, close your account.
